I am just furious I found this person selling this on ebay.. I just don't believe that can be done.

I agree, it's one hell of a cheek selling Audacity on e-bay - they're not even putting it on disk - "Digital Delivery".

This is probably illegal.

It's perfectly legal to sell Audacity, provided a few basic legal requirements are met detailed here:

This eBay listing appears to fit all these requirements, though it's in very poor form to not make mention of it being an otherwise free program. If there is a way to ruin this guy's rep on eBay, then have at it.

Due to the terms of the GPL, the Audacity Team has no legal grounds to stop this seller, provided they haven't altered Audacity in any way. Hopefully people reading the listing will do a quick search for Audacity and find out that it's actually free.

That's the bit that I thought might be illegal, but sadly you are correct.
According to the GPL, the following is advised and not required;
First and foremost, be honest. Give proper credit to the Audacity project as the originator of your software by linking to our homepage, and explaining that Audacity is a freely available download

Last time I checked I thought Ebay had some sort of conditions about selling software in there Ts&Cs, which is about the only real option - persuading Ebay not to let people list open-source software on there because it's so rarely done right. They have similar restrictions for alcohol I think.
