The LAME encoder forces the sample rate down lower if you use some of the smaller bit rates. I know for sure that the 64kbps rate will drop the sample rate down. Not sure about 96kbps.

In that case you would need to save as an Audacity project. No other program will be able to open it, but the markers will stay put.
