That's good to know, I never knew that. I guess I've never tried to open up two different instances of 1.3.3. But 1.2.6 definitely doesn't work.
You also can't have 1.2.6 and 1.3.3 open at the same time.

But I'd bet that you don't have "play other tracks while recording" selected in Audacity's Edit -> Preferences -> Audio I/O menu. I'm 99% sure that's the problem.

You're right, LAME doesn't support high sample rates at low bit rates. Technically the MP3 format allows for it, but LAME won't let you. Yes, you can copy/paste the code into a text editor. Save the file as a .NY file and put it in Audacity's Plugins folder. It will show up upon Audacity's next startup. It depends on how that piece of equipment works.
Does Windows recognize it as a sound card? If it does then you should be able to select it in Audacity's Edit -> Preferences -> Audio I/O menu.
