This isn't a forum for legal queries, and if it was you would probably get different answers from different people. Yes it was committed to source code on the 28th, so appeared in the nightly build George tried. Now it's in the code, it will appear whenever we build a 1.3.x release.

1.3.6 when it comes out should be able to import Wavpack, if you install the optional FFmpeg library, but not export it, because FFmpeg doesn't.

What's going on is that we have just released a series of internal 1.3.6alpha builds with new features developed by Google Summer of Code (GSoC) students. Next we polish those new features so they are good enough for 1.3.6 Beta - maybe that will come in a month or two? Then we do one mountain of bug...

The whole thing is open to a lot of interpretation, and depends if the software and the user are in a country that respects patent law. If your application is distributed in USA, able to export MP3 but does not include a LAME binary, and the application is free, you're like Audacity and you are prob...
