So you can use the same command line arguments (same files) and Audacity will open successfully on one occasion, but on another occasion (with exactly the same arguments and files) it will fail?

Both files are opened at the same time and them imported in parallel How do you see that happen? Are they very large MP3s? I doubt that it would be "quicker" overall.
Labels can be created extremely quickly (Ctrl + B), or during playback / recording you can mark the current play position on the fly with Ctrl + M. How did you envisage setting the colour of a section of a track?

No, Audacity can't do that, but you can mark sections with "Labels". See: https://manual.audacityteam.org/man/label_tracks.html

This sometimes happens with the default record and/or playback settings. The defaults use PulseAudio (the same as the "Pulse" setting.
Look in the device toolbar and select the "hw" devices that correspond to your recording / playback device(s).

Audacity doesn't (can't) apply effects during recording or playback.
